These Terms of Service ("Terms") govern your use of the DockDineFuel platform, operated by PricePoint 369 LLC, doing business as DockDineFuel ("DockDineFuel," "we," "us," or "our"), including our website at dockdinefuel.com and our mobile application (collectively, the "Platform"). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

Marketplace Disclaimer

DockDineFuel is a technology marketplace that connects boaters with waterfront businesses. DockDineFuel is not a party to any reservation, booking, or transaction between boaters and businesses. All reservations are agreements solely between the boater and the waterfront business. DockDineFuel assumes no responsibility or liability for the actions, services, safety, quality, legality, or availability of any business listed on the Platform, nor for any disputes, injuries, damages, or losses arising from reservations or visits to listed businesses. DockDineFuel is not a marina operator, harbor master, or maritime authority and has no control over waterway conditions, dock operations, or vessel traffic.

1. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent that you meet this requirement and that all information you provide is accurate and complete.

The Platform is not intended for use by persons under the age of 18. By using the Platform you confirm you are not a minor as defined by applicable law in your jurisdiction. If you are under 18, you are not permitted to create an account or use any feature of the Platform.

2. User Accounts

  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use at hello@dockdinefuel.com
  • We reserve the right to suspend or terminate accounts that violate these Terms at any time and for any reason without prior notice

3. Reservations & Bookings

When you make a reservation through DockDineFuel:

  • Your reservation request is sent to the waterfront business for their confirmation
  • A reservation is not confirmed until the business explicitly confirms it
  • Businesses are expected to confirm or decline reservation requests within 24 hours. DockDineFuel is not liable for reservations that go unconfirmed or are confirmed late
  • DockDineFuel is not responsible if a business cancels, modifies, or fails to honor a reservation
  • Any cancellation policies are set by the individual business, not DockDineFuel
  • You are responsible for providing accurate vessel information including draft, beam, and length when making a reservation
  • DockDineFuel does not guarantee dock availability, water depth, or suitability for your vessel
  • Boaters are solely responsible for verifying current water depth, tidal conditions, and navigational hazards before entering any dock or waterway. Depth information listed on the Platform is provided by the business and may not reflect current tidal or seasonal conditions. DockDineFuel recommends consulting NOAA tide charts or a certified marine navigation tool before docking
  • Boaters are responsible for ensuring their vessel's draft, beam, and length are compatible with the listed dock specifications. DockDineFuel makes no guarantee that any listed dock is suitable for any specific vessel
  • Users are solely responsible for complying with all applicable maritime, docking, and navigational laws and regulations in their jurisdiction

4. Payments & Subscriptions

  • Boater access subscriptions are billed monthly or annually through Stripe
  • Business subscriptions are billed monthly or annually through Stripe
  • All payments are processed securely by Stripe. DockDineFuel does not store payment card information
  • Subscriptions automatically renew until cancelled
  • Refunds are handled on a case-by-case basis — contact hello@dockdinefuel.com
  • DockDineFuel does not process payments between boaters and businesses. Any dock fees or dining charges are paid directly to the business

5. Business Listings

If you list your business on DockDineFuel, you agree that:

  • All listing information you provide is accurate and up to date including dock dimensions, depth, amenities, hours, fuel availability, and menus
  • You have the legal right to offer dock space to visiting boaters
  • You are solely responsible for ensuring your dock facilities are safe and compliant with applicable laws and maritime regulations
  • You will honor confirmed reservations to the best of your ability
  • You are responsible for maintaining accurate and current depth and tidal information on your listing
  • DockDineFuel may remove listings that violate these Terms or contain inaccurate information
  • New listings are subject to review and approval by DockDineFuel before going live

6. Accuracy of Information

DockDineFuel does not guarantee the accuracy, completeness, or reliability of any information provided by businesses on the Platform, including but not limited to photos, amenities, hours of operation, menus, fuel availability, dock conditions, and water depth. All information is provided by the business and may change without notice. Users should verify all information directly with the business before visiting.

7. Platform Availability

The Platform may experience outages, interruptions, or reduced functionality due to maintenance, technical issues, or circumstances beyond our control. DockDineFuel does not guarantee continuous, uninterrupted, or error-free operation of the Platform. We are not liable for any losses or damages resulting from Platform downtime or unavailability.

8. Limitation of Liability

To the maximum extent permitted by law, DockDineFuel shall not be liable for:

  • Any injury, death, property damage, or loss arising from use of a waterfront facility
  • Any dispute between a boater and a business
  • Weather conditions, tides, storm surge, or navigational hazards
  • The accuracy of water depth, tidal conditions, dock dimensions, or facility information provided by listed businesses
  • Any vessel damage resulting from insufficient water depth, tidal changes, or dock conditions
  • Loss of data, revenue, or profits
  • Fuel dock listings are provided for informational purposes only. DockDineFuel does not verify fuel availability, pricing, pump condition, or hours of operation. Boaters are solely responsible for confirming all fuel-related information directly with the facility before navigating to any listed location
  • Any indirect, incidental, or consequential damages
  • Any failure of a boater to verify current tidal or navigational conditions prior to docking
  • Platform outages or interruptions occurring during a reservation or booking
  • DockDineFuel is a reservation and discovery platform only. We are not responsible for the actions, behavior, or safety of any user before, during, or after visiting any listed business. Boaters are solely responsible for operating their vessel safely and in compliance with all applicable federal, state, and local laws, including laws governing the operation of a vessel under the influence of alcohol or controlled substances. DockDineFuel assumes no liability for any injury, accident, property damage, or legal consequence arising from the operation of a waterway vessel

DockDineFuel's total liability to you shall not exceed the amount you paid to DockDineFuel in the 3 months preceding the claim.

8a. Vessel Operation & Intoxication

DockDineFuel expressly disclaims all liability for the operation of any watercraft by any user who has consumed alcohol or controlled substances. Boating under the influence is illegal under federal and state law. DockDineFuel does not encourage, condone, or accept responsibility for any boater who operates a vessel while impaired. By using the Platform to make reservations at waterfront restaurants or bars, you acknowledge that you are solely responsible for designating a sober operator for your vessel. DockDineFuel shall have no liability of any kind for any incident, injury, death, property damage, citation, arrest, or legal consequence arising from the operation of a vessel by an impaired person, regardless of whether that person used the Platform to visit a waterfront business serving alcohol.

9. Indemnification

You agree to indemnify, defend, and hold harmless PricePoint 369 LLC d/b/a DockDineFuel, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses including reasonable attorney's fees arising out of or related to:

  • Your use of the Platform
  • Your vessel's operation or navigation
  • Your visit to any listed waterfront business
  • Any breach of these Terms by you
  • Any damage to your vessel or another vessel arising from docking at any listed location
  • Any personal injury or property damage occurring at or near any listed waterfront facility

This indemnification obligation survives termination of these Terms and your use of the Platform.

10. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Broward County, Florida. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section shall prevent DockDineFuel from seeking injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect its intellectual property or confidential information.

11. No Professional Advice

Nothing on the Platform constitutes professional maritime, navigational, legal, or safety advice. Depth, tide, and dock information displayed on the Platform is provided for general informational purposes only. Boaters should always consult official nautical charts, NOAA tide data, and certified marine navigation tools before making docking decisions. DockDineFuel is not responsible for any decisions made based on information displayed on the Platform.

12. Communication Consent

By creating an account on the Platform, you consent to receive communications from DockDineFuel including reservation confirmations, booking updates, and platform notifications via email and in-app notifications. You may manage your notification preferences within your account settings. DockDineFuel will not sell or share your contact information with third parties for marketing purposes.

13. Prohibited Conduct

You agree not to:

  • Post false, misleading, or inaccurate information
  • Use the Platform for any unlawful purpose
  • Attempt to circumvent the Platform by contacting businesses outside of it to avoid subscription fees
  • Harass, threaten, or harm other users or businesses
  • Attempt to reverse engineer or exploit the Platform

14. Reviews

Reviews submitted through the Platform must be honest and based on your genuine experience. DockDineFuel reserves the right to remove reviews that violate these Terms, contain false information, or are otherwise inappropriate. Reviews are only available to boaters who have had a confirmed reservation at the listed business.

15. Intellectual Property

All content, design, and technology on the Platform is owned by PricePoint 369 LLC d/b/a DockDineFuel. You may not copy, reproduce, or distribute any part of the Platform without our express written permission. By uploading photos or content to the Platform, you grant DockDineFuel a non-exclusive license to use that content on the Platform.

16. Force Majeure

DockDineFuel is not liable for any failure to perform due to circumstances beyond our reasonable control including but not limited to acts of nature, weather events, hurricanes, storm surge, tidal events, government actions, maritime authority decisions, or third party service outages. In such events DockDineFuel will make reasonable efforts to notify affected users and businesses.

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes not subject to arbitration shall be resolved in the courts of Broward County, Florida.

18. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes via email or in-app notification. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
